1. INTRODUCTION
1.1 This policy sets out the privacy policy of Creative Spirit SAS. Creative Spirit SAS is a company registered in France under company number FR17399115070, whose registered address is 11-13 Avenue Isola Bella 06400 Cannes.
1.2. For the purpose of applicable data protection and privacy laws, and unless otherwise stated below, Creative Spirit is the data controller in relation to the personal information covered by this Privacy Policy.
1.3 Creative Spirit is committed to protecting the privacy of its users. The purpose of this Privacy Policy is to describe to you how Creative Spirit will use personal information about you that is submitted to Creative Spirit. If at any time you wish to access, change or delete the personal information we hold about you or opt-out of or change the uses of your personal information, or if you wish us to transfer your data to a third party, please contact us at [email protected].
1.4 Creative Spirit may revise this Privacy Policy at any time by posting an update on its website(s). Please ensure that you check this website and any other Creative Spirit website(s) you use from time to time to review the then current Privacy Policy and to update your preferences.
2. COLLECTION OF PERSONAL INFORMATION
2.1 Depending on the circumstances in which we collect your information (as set out in paragraph 2.2 below) the types of personal information we collect and store may include your name, job title, place of work or study, date of birth, e-mail address, postal address, mobile number. In case of on-line payment by credit card your payment pass directly through the bank web platform any details is stocked.
2.2 Creative Spirit (or third parties acting on Creative Spirit’s behalf) may collect personal information about you in the following ways:
(a) when you complete and submit an application to Creative Spirit to register on its website(s) or receive email alerts or other communications from Creative Spirit;
(b) via postings to forums and blogs and any other posting that you make to a Creative Spirit website (in such circumstances the information posted by you may, of course, also be available to users of the forum/blog/website throughout the world);
(c) during any transaction with us; and
(d) when you enquire about our activities, email, telephone or write to us or otherwise provide us with personal information.
3. STORAGE AND RETENTION OF YOUR INFORMATION
3.1 Creative Spirit will keep your information securely. The technology that Creative Spirit uses and the security policies which Creative Spirit has implemented are intended to safeguard your information from unauthorized access and improper use.
3.2 Creative Spirit will keep your information (to the extent permitted by the Privacy Laws) to enable Creative Spirit to use it for the purposes described in this Privacy Policy. We will keep your personal information for no longer than is needed for those purposes.
4. USE OF YOUR INFORMATION
4.1 Creative Spirit may use your personal information to provide services to you, for example when you register to an event or buy a pass. In more detail, we may include using your personal information for the following purposes:
(a) administering your website account(s) and otherwise in connection with any service for which you have provided your information, including event registration, accommodation reservation, transactions with us and competitions that you take part in;
(b) responding to any enquiry you make;
(c) sending you newsletters and/or alerts and information regarding Creative Spirit’s services;
(d) for generating aggregated statistics about event participants and other services and developing Creative Spirit's offer plans.
4.2 Creative Spirit may also disclose your information (subject in each case to the requirements of the Privacy Laws) as follows:
(a) to third parties who are engaged by Creative Spirit to exercise its rights under Clause 4.1;
(b) to third parties selected by Creative Spirit as part of aggregated and anonymised statistics about users, traffic patterns etc. of the Creative Spirit website(s);
(c) to such individuals and/or bodies as necessary to; ensure Creative Spirit’s compliance with any applicable law, regulation, legal proceeding or governmental request;
(d) to third party providers as necessary to properly deal with your request, for example to accommodation providers where you have requested accommodation at an event;
(e) (where you post material that does or may constitute a criminal offence, breach the rights of a third party, give rise to a civil action or breach the terms & conditions of the applicable website and as otherwise necessary to protect the rights, property or safety of Creative Spirit and its customers), to any relevant authority or third party requiring Creative Spirit to disclose the identity of or locate anyone posting such material on an Creative Spirit website; or
(f) to third parties selected by Creative Spirit who will be present at Creative Spirit events (e.g. selected festival sponsors) so that they can better plan the activities they offer to visitors to those events.
4.3 If Creative Spirit (or a relevant part of Creative Spirit) is acquired by or merges with another company, your personal information may be passed to the purchasing/merging company amongst the transferred business assets. This will enable your relationship to continue with the relevant Creative Spirit business despite the change of ownership. Your personal information may also be passed (on a confidential basis) to companies with whom Creative Spirit is negotiating such a sale/merger as part of the verification exercise carried out on Creative Spirit by the third party.

Creative Spirit website(s) do not use “cookie” technology.
6. THIRD PARTY WEBSITES
Please be aware that Creative Spirit does not control and is not responsible for websites that are referred to or linked from its own websites and that use of your personal information on these websites is not subject to this Privacy Policy.

7.1 To access certain parts of the Creative Spirit websites, Creative Spirit may require you to register and provide certain information about yourself.
7.2 You are reminded that in addition to the provisions of this Privacy Policy, where you register you also agree to:
(a) provide true, accurate, current and complete information about yourself as prompted by the relevant registration form (such information being the "Registration Data"); and
(b) maintain and promptly update the Registration Data to keep it fully up to date.

Terms and conditions
PREAMBLE
These general terms and conditions govern the sale of The Scene Weekly Cards. This service is offered by Creative Spirit.
ARTICLE 1 - PRICE
1.1 Weekly Cards prices are given in Euros, inclusive of tax.
1.2 Once the Weekly Cards are purchased you will receive an invoice by email. The Weekly Cards will not be mailed to you, but are to be picked up at the Palais des Festivals at The Scene Desk.
1.3 All orders whatever their country of origin are payable in Euros.
1.4 Weekly Cards remain the property of the event organiser until the amount of the sale has been paid in full and has been credited to Creative Spirit.
ARTICLE 2 - PAYMENT
You will be given the choice between 4 different payment options:
1) on line credit card payment;
2) credit card payment via terminal, by completing and returning credit card form to Creative Spirit;
3) payment by bank transfer;
4) payment by cheque in € and payable on a French bank.
We accept the following credit cards: Carte Bleu, Visa, Eurocard, Mastercard and American Express.
2.1 By paying on line by credit card, you immediately secure your order of Weekly Cards.
2.2 By paying by credit card terminal, wire transfer or cheque, you have to wait until complete payment has been received by Creative Spirit before your order of Weekly Cards can be processed.
ARTICLE 3 – RIGHT OF WITHDRAWAL
You may cancel your order for any reason at any time up to the end of the seventh working day after you placed your order of Weekly Cards. A "working day" means any day other than Saturdays, Sundays and public holidays. If you do wish to cancel your order, the following term will apply.
To cancel your order you need to contact us by email at [email protected]. Please mention you wish to cancel your order and attach the invoice you received by email at the time of your order.
ARTICLE 4 - PAYMENT DATA PROTECTION
Our website is protected by a security system. We have chosen to use SSL encrypting but have also reinforced all the scrambling and encrypting procedures in order to more efficiently protect any sensitive data linked to payment methods.
ARTICLE 5 - CONFIRMATION
You declare that you have read and accepted these general terms and conditions of sale before placing your order. By confirming your order, you are accepting these general terms and conditions of sale. Except where indicated, the data registered by Creative Spirit constitutes proof of all of the transactions made through Creative Spirit and its clients.
Your Weekly Card order can only be confirmed and will only bind Creative Spirit once you receive the email confirming your order and its attached invoice. Consequently, please consult your email inbox regularly after placing your order.
ARTICLE 6 – COLLECTION OF THE WEEKLY CARDS
Your Weekly Cards are to be picked up at the Palais des Festivals at The Scene Desk. To guarantee maximum security, Weekly Cards can only be picked up on presentation of the invoice we emailed you after you placed your order plus a business card of the person picking up the Weekly Cards. Without this invoice and identification, you will not be able to pick up your Weekly Cards.
ARTICLE 7 - CANCELLATION OR REFUNDS
Weekly Cards cannot be refunded, even if lost or stolen, and cannot be returned or exchanged.
Weekly Cards will only be refunded if the event is cancelled by the organiser. The amount refunded will be calculated according to the number of events cancelled, on a pro rata basis.
Events cancelled because of an Act of God will not be refunded.
ARTICLE 8 - APPLICABLE LAW - DISPUTES
Weekly Cards sales referred to in these terms and conditions are subject to French law. In the event of a dispute, only the French courts will have jurisdiction.
